Brad is a co-founding partner of Thorpe Shwer who practices in the areas of commercial litigation, business torts, franchise litigation, personal injury torts, and products liability. He represents his clients in a variety of contractual disputes, business tort claims, personal injury defense, product liability claims, employment litigation, franchise litigation, premises liability claims, insurance litigation, collections, and deficiency actions. Brad has litigated and tried cases in dozens of states around the country in both federal and state court.
Along with his partner Bill, Brad co-founded Thorpe Shwer to create a law firm that provides quality litigation services, as well as a dedication to strong client relationships, efficient and aggressive representation, and personal service. Obtained complete summary judgment in a Nevada District Court case brought by the injured plaintiff and his spouse arising out of a New Mexico accident, in which the plaintiff was struck by an Amtrak train. After summary judgment briefing related to the duty owed to trespassers, premises liability, and derivative claims, the United States District Court for the District of Nevada granted summary judgment on behalf of Amtrak and BNSF Railway Company, resulting in dismissal of all claims.
Wes. C. Davis v. BNSF Railway Company, No. 1 CA-CV 13-0083 (April 1, 2014)
Obtained complete summary judgment for BNSF Railway Company in a case arising out of a fatal grade crossing accident brought by the injured driver and the representatives of the deceased passenger. After extensive briefing related to, among other things, the federal preemption of plaintiffs' claims, the court granted summary judgment to BNSF, resulting in the dismissal of all claims against BNSF.
